ECHR HOLDS HEARINGS IN ANKARA AND STRASBOURG

Press Release: 7 March 1996


The European Commission of Human Rights held Investigative Hearings and an Admissibility Hearing on Kurdish cases in January and February and a further Investigative Hearing is scheduled for March. These are: Five Investigative Hearings in Ankara in February on cases that deal with allegations such as village destruction, torture and ill-treatment, and killing.

One Admissibility hearing was in Strasbourg in late January in the case of Tas v. Turkey.

One further Investigative Hearing on Tekin v. Turkey, which deals with allegations of torture while in detention to which he was subjected because he is a journalist, scheduled for Strasbourg on 7 March. (Please see November Press Release on previous Tekin Investigative Hearing.)

The individual applicants were assisted in taking their grievances to Strasbourg by the Kurdish Human Rights Project and the Human Rights Association of Turkey. Specifically, the cases heard in January and February concern the following allegations:

Tas v. Turkey (24396/94): the disappearance and possible death of the son of the applicant while in Turkish police custody. Articles cited include Article 2 (right to life), Article 3 (prohibition of ill-treatment), Article 5 (right to liberty), Artlcle 13 (right to effective national remedies), Article 14 (freedom from discrimination) and Article 18 (prohibition of the use of restrictions for improper purpose). Selcuk v. Turkey (23184/94) and Asker v. Turkey (23185/94): the destruction of property and the applicants' forced eviction from their village. Articles invoked include article 3 (prohibition of ill-treatment), article 5 (right to liberty), Article 6 (right to access judicial system), Article 8 (right to respect for family life), Article 13 (right to effective national remedies), Article 14 (freedom from discrimination) and Article 1 of Protocol 1 (right to property).

Aslan v. Turkey (22491/94 and 22497/94): the ill-treatment and assault of family members by Turkish security forces, as well as the destruction of family property. Articles invoked include those mentioned above.

Ergi v. Turkey (23818/94): the death of the sister of the applicant caused by indiscriminate shooting by security forces. Articles cited include Article 2 (the right to life), Article 8 (right to respect for family life), and Article 14 (freedom from discrimination).

Kurt v. Turkey (24276/94): the disappearance of the son of the applicant while the son was in custody. Articles cited include Article 2 (right to life), Article 3 (prohibition of ill-treatment), Article 5 (right to liberty) and Article 25 (right to individual petition).
